12. Cats can live a long time. Are you prepared to keep your pet permanently? And you understand that under no circumstances should this adopted cat be placed in any other home but the name on this application. And if at any point you can no longer care for said pet it shall be returned to, ADRA FOSTER with Royal Velvets, immediately. You understand that, ADRA FOSTER, has first rights to refusal.

13. It is understood that no Sphynx is completely hairless and that “hair” may grow from time to time changing the appearance of your kitten/cat. This is an acceptable, normal trait of the sphynx and is not a condition that deserves cause for refund.

14. You understand that you are ‘adopting’ a kitten/cat and there are no health guarantees. However, while in our care, kitten/cat has been prescreened for diseases – but this does not prevent some diseases from developing. We do provide a 72 hour limited warranty guarantee that the above kitten/cat is in good health at the time of purchase – other than any noted items in special instruction section. It is the responsibility of the adopter to continue with the preventable care and yearly screenings as well as any special instructions notes (medication, special food, etc). It is also the adopter’s responsibility to continue vet care on a regular basis. Adopter also accepts all responsibility for protection of cat from said diseases, viruses, illnesses, parasites and fungi.

15. Kitten/Cat will be current on all vaccines prior to leaving our home. All kittens will have age-appropriate vaccinations, deworming, and appropriate spay/neuter. As the buyer, you agree to not have your kitten re-vaccinated for at least 3 weeks after the date of the prior vaccination as that can make your kitten very sick. Adopter understands that the Breeder utilizes Modified Live and Intranasal Live vaccines. These vaccines introduce a safe live version of the diseases we wish to vaccinate against. This can cause false positives on PCR tests done close to vaccination, and can cause illness ranging from mild infection to reverted virulence. This is normal and common reaction. Buyer will educate themselves on vaccine reactions and allow cat time to recover from vaccination before determining the cat is ill or a chronic viral shedder.

16. Adopter agrees to never post photos of this adopted kitten/cat on any public sphynx or devon rex community page or group page – other than the Royal Velvet Family Group page. Here, we actively encourage you to post photos and updates, share stories and ask questions. We do also encourage you to share positive images and posts with your own networks and encourage others to learn more about Royal Velvet Sphynx if interested. However, You agree not to make any negative references or posts about Royal Velvet Cattery and/or individual (Adra Foster) on any social media outlet and/or publication of any type.

17. Feline Leukemia and FIP Inoculation is very dangerous to your cat and could cause death. Please research. You agree to never vaccine against feline leukemia and FIP.

18. You understand that we have the right to refuse and/or cancel at any given time, or reason, as we see fit. You also understand that these breeds are strictly an indoor cat only. And under no circumstance shall the kitten/cat be declawed. By doing so is automatic breach of contract and immediate surrender back to us.

19. You understand that we reserve the right to repossess said cat in the event of failure or refusal of the adoptee to comply with the terms of this Agreement with all repossessing fee's being paid by buyer. In addition, breach of contract penalty is $600 per item, PLUS $2,500.00 in punitive damages. Buyer will be liable for any court costs and related charges, including attorney fees, associated with Seller enforcing the terms of this contract. This legally binding contract is the exclusive agreement between the Buyer and Sellers and supersedes any and all prior oral or written agreements, negotiations or other dealings between them concerning the purchase and sale of the kitten/cat.

20. Royal Velvet does not offer any guarantees against HCM or any other genetic or congenital disorders on our adoptees. However, we do pre – screen all of our breeding adults for HCM and other genetic predispositions. Any cats with positive or questionable results – are removed from our breeding program immediately

21. In the event that a dispute arises relating to or stemming from this Agreement, both parties agree to refrain from using any social media outlets, including but not limited to Facebook, Twitter, Instagram, Google+, YouTube, Pinterest, and LinkedIn to discuss the dispute and/or Cattery or Individuals in any manner. Mediation or legal remedies will be the appropriate avenue to discuss and remedy any disputes that should arise. Both Parties hereby acknowledge that a breach of this paragraph would cause Cattery to suffer a loss which could not be adequately compensated for by damages and consents that in addition to any other remedy or relief available to it, Royal Velvet Sphynx may enforce the performance of this subsection by injunction or specific performance upon application to a court of competent jurisdiction without proof of actual damages to Cattery and notwithstanding that damages may be readily quantifiable and Adopter covenants that it will not plead sufficiency of damages as a defense to any proceeding for such injunctive relief brought by Royal Velvet Sphynx.

22. Adopter understands that yearly HCM screening is very important to the future of our breeding program. Therefor, it is required to HCM screen your cat yearly until the age of 10, in which at that point, we no longer require but do recommend to continue to screen yearly. Help with finding an affordable clinic will be supplied – but is recommend that you find a clinic prior to adoption. Results of HCM screening shall be sent to breeder via email only. royalvelvetsphynx@gmail . There are no exceptions with this. IF you do not yearly screen for HCM and supply results – you will be in breach of contract. At that point, you will be required to return the cat to us, at your expense.

PURCHASERS SIGNATURE INDICATES FULL AGREEMENT AND UNDERSTANDING OF ALL THE TERMS AND CONDITIONS OF THIS PURCHASE CONTRACT. THIS DOCUMENT IS A LEGAL AND BINDING CONTRACT. THE LAWS IN THE STATE OF TENNESSEE SHALL BE IN CONTROLLING.
